Mandatory Minimum Sentencing Variances

The Fifth Circuit holds in United States v. Montes, No. 08-10932 (5th Cir. Mar. 26, 2010) (Reavley, Davis, Stewart), that absent a Government Substantial Assistance Motion or Safety Valve qualification, a District Court may not impose a sentence below the statutory minimum mandatory sentence.
